Question 1

Can a non-tribal buy land in Jharkhand under the CNT Act?

Accepted Answer

Generally no. Section 46 restricts tribal land sales to other Scheduled Tribe members within the same revenue Thana, with Deputy Commissioner approval. Non-tribal purchases are allowed only for industrial purposes through a separate route.

Question 2

What is the difference between the CNT Act and the SPT Act?

Accepted Answer

The Chotanagpur Tenancy Act, 1908 covers North Chotanagpur, South Chotanagpur, and Palamau, including Ranchi, Ramgarh, and Bokaro. The Santhal Parganas Tenancy Act, 1949 governs a separate region and is even more restrictive on transfers.

Question 3

How do I check if land falls under CNT or SPT protection?

Accepted Answer

Pull the Khatian on jharbhoomi.jharkhand.gov.in using the survey number or Khata number. The land classification column shows tribal status, which determines whether Section 46 or Section 49 rules apply.

Question 4

Is a tribal-to-tribal land transfer easier than a tribal-to-non-tribal one?

Accepted Answer

Yes. Tribal-to-tribal transfers within the same community are permitted under the CNT Act without Deputy Commissioner sanction, though the transfer still needs registration and mutation in the buyer's name.

Question 5

What is Section 71 of the CNT Act and why does it matter to a buyer?

Accepted Answer

Section 71 allows a transfer to be reopened and reversed later if proper sanction was never actually obtained, even if the sale looked complete and registered at the time it happened.

Question 6

What does JharBhoomi show that Jharnibandhan does not?

Accepted Answer

JharBhoomi shows land ownership and classification through the Khata and Register-II. Jharnibandhan only records the registration of a transaction; it does not confirm the underlying sale was legally valid.

Question 7

Is the Raipur-Ranchi-Dhanbad Expressway fully complete yet?

Question 8
