What documents are required to be produced for a thorough legal verification?
Sethwar - It is the record of all the survey numbers and the extent of land inside each survey number, for a village. This was created in the 1940s and is considered the ‘mother document’ for revenue records.
Pahanis/Adangal - They are the records of all the lands in each village, containing the survey numbers, land owners’ & cultivators’ details, for each crop year.
Khasra Pahani - This was the first pahani, recorded in 1954-55.
RoRs/1B - Record of rights - Is issued by the Tahsidar and contains the land status and the current legal ownership.
Sale deeds - Registered sale deeds, through which the current owner had purchased the land from the previous owner.
Link documents - These can be the sale deeds or the partition deeds etc. to trace the flow of ownership of the land between all of the previous owners.
Partition deeds - When a land is split in a family or is passed on to the kin, after death of the then land owner. The partitioning or distribution of assets are carried out, through a partition deed.
Passbook - The current owner has a pattadar passbook, issued by the Govt. of Telangana, which contains records of all the lands owned by an individual, in each village.
Masterplan extract - In case the land falls under any of the urban development authorities or any other area, which has a masterplan, it would be better if you know what the land use of that particular area is, as per the masterplan. (Ex: Residential/commercial/conservation zones)
Court case verdicts (if any) - If there are any cases on the land or previous verdicts, that can be obtained, from the concerned court.
Encumbrance Certificate (EC) - Search EC, is a record of all the transactions that have happened in a particular survey number of a village. Certified EC can be obtained from the SROs office.
Village map - It's a map showing all the survey numbers in a village. These were first prepared in the 1940s, along with Sethwars and Tippons. In some of the villages, few survey numbers have changed later and additional survey numbers got added, and care should be taken to notice these.
Tippon - It's the map of exact measurements of each survey number. Tippons were created along with Sethwars and village maps, in the 1940s.
What if I don’t have any or some of the above documents?
A lawyer gives a legal opinion, based on the available list of documents. It would be your responsibility to provide all the necessary documents. The lawyers would discuss with you, on a case by case basis, as to which documents are absolutely mandatory and which can be overlooked. It's a subjective process (hence, called ‘the legal opinion’) and you can take the final decision, based on the lawyer’s opinion.
Where do I get the required documents for the legal verification?
Khasra Prahanis, Pahanis and the RoRs are available at the respective Tahsildar’s office (MRO). Sethwars & Village maps can be obtained from the AD-Survey’s office, at the district collectorate. Sale deeds, link documents and certified ECs from the Sub-registrar’s office.
How much time will it take for a thorough legal verification?
Usually once all the documents are produced, the lawyer might take a week’s time to give his/her legal opinion. But in some cases, the lawyer might ask for more documents and the to and fro can take more time, depending on a case by case basis.
How much will it cost me for a thorough legal verification?
The pricing would be 10,000/- per acre, up to 5 acres. Will slightly reduce with the increase in acreage. However, the final pricing will depend on the complexity of that particular land. .
