The Aircraft Act, 1934 requires an NOC from AAI's NOCAS portal for any structure near a notified aerodrome, civil or military, based on distance from the aerodrome reference point and a colour-coded permissible top elevation. Separately, the Works of Defence Act, 1903, a law that predates independence and is still fully in force, lets military authorities restrict construction near defence establishments regardless of AAI clearance. Current Ministry of Defence guidance under this framework caps construction within 100 meters of a defence installation outright, extending to 500 meters for any building taller than four floors, and an NOC from the local military authority is required in that band.

Courts have already drawn a hard line on how far executive guidelines can go here. The Karnataka High Court struck down a defence NOC refusal in Bengaluru, ruling that once the Works of Defence Act occupies the field, executive circulars can't add restrictions beyond what the Act itself allows, and doing so violates the right to property. That cuts both ways for a buyer: the underlying Act still applies in full near Dundigal and Hakimpet, but a blanket denial without statutory basis can be challenged.
